Because of a default in the payment of the indebtedness secured by a Security Deed executed by LARRY MAYNARD and LINDA T. MAYNARD to WELLS FARGO BANK, N.A. dated April 7, 2008, and recorded in Deed Book 52B, Page 300, Jackson County Records, securing a Note in the original principal amount of $290,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, March 1, 2011, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that lot, tract or parcel of land, together with all improvements thereon, situate, lying and being in the 1747th District, G.M. of Jackson County, Georgia, and being known and designated as Lot 28, Block A, of Harris Hills Subdivision, lying on the westerly side of?of survey entitled “Final Plan for Harris Hills,” prepared by W.T. Dunahoo and Associates, certified by W.T. Dunahoo, Registered Surveyor, dated April 13, 2001, which plat is recorded in Plat Book 57, page 189, Jackson County Records, and is incorporated herein by reference thereto.
Said property is known as 473 Harris Hills Drive, Athens, GA 30607, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Larry Maynard and Linda T. Maynard, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Larry Maynard and Linda T. The last day to register to vote in this election shall be February 14, 2011, through 5:00 p.m.
Those residents of Jackson County qualified to vote at such election shall be determined in all respects in accordance with the election laws of the State of Georgia.

WHEREAS, the Boards of Education of Jackson County, Jefferson City and Commerce City (the “Boards of Education”) have furnished the Election Superintendent (the “Election Superintendent”), with a certified copy of their resolutions adopted on December 13, 2010, December 9, 2010 and December 13, 2010, respectively (the “School District Resolutions”) calling an election pursuant to Sections 48-8-140, et seq. and 48-8-111, et seq., of the Official Code of Georgia Annotated, as amended, to determine whether a one percent sales and use tax as authorized by Article 3 of Chapter 8 of Title 48 of the Official Code of Georgia Annotated shall be continued for the purposes set forth in the School District Resolution, and has requested that the Election Superintendent join the Boards of Education in the call of the election for such questions on March 15, 2011; and
