Police responded to an argument between a boyfriend and girlfriend at their Pine Street apartment after the girlfriend had left for the night in her boyfriend’s truck — abandoning their two-and-a-half year old son— and came back to retrieve some clothes, a Jefferson Police Department incident report states.
The officer asked the boyfriend to allow his girlfriend to get some clothes and let her leave again to cool off. While she was inside supposedly getting clothes, she woke the child up and announced that he was going with her. The officer told her she could return the following day and take the boy, but because she abandoned him during the night, he would stay with his father. The father told police he would get in touch with an attorney to try to get custody of the child.
Sounds more like a custody type issue. If your spouse left you and your kids then came back later that night, and wanted to take the kid with them. That would be unacceptable. I'd also say, they left the kid,so the kid is staying with me.
A.J.S.- This whole ordeal is sounding a little FUNNY? The situation, the story as reported in the paper BECAUSE I don't know many Mothers that would leave their child behind? Most Mothers I know will fist fight you until you KILL them over their kids.
-boyfriend and -girlfriend-- How many wanna bet that paternity has not even been established yet? If it has not been then "the father" has no rights, legal or otherwise, period(until a court says so), and regardless, I'm just wondering if this even occured to the officer before he made his decison. This is just one issue I have with this whole situation. Something doesn't seem on the up and up or doesn't add up here.

..Oh how nice! ..They ALLOWED her to get some of her clothing and LET HER cool off and leave again -- Lucky girl that one...She doesn't have to have permission! Too bad she was not allowed to get her own child from someone who was most likely a legal stranger.
Someone needs to look into this asap, just my opinion.
Kay- You are 100% correct. If the woman in question lived with the man in question she DON'T have to have permission she has just as much right to be there as he does. I know from experience if he is the father it will be hard for him to win custody of SAID child IF she don't just give him custody. When I divorced I was going to fight for custody of my kids BUT several Lawyers told me that was fighting a losing battle? They told me that 9 times out of 10 the women wins a custody suit. They told me you had to prove the woman UNFIT? AND one lawyer told me it would be easier to prove "Big foot" exsist than to prove a woman UNFIT?
