Because of a default in the payment of the indebtedness secured by a Security Deed executed by ROSE A. HERNANDEZ to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. dated April 2, 2004, and recorded in Deed Book 34-B, Page 139, Jackson County Records, said Security Deed having been last sold, assigned, transferred and conveyed to The Bank of New York Mellon, fka The Bank of New York as Successor in interest to JP Morgan Chase Bank, NA as Trustee for Structured Asset Mortgage Investments II Inc. Bear Stearns ALT-A Trust 2004-6, Mortgage Pass-Through Certificates, Series 2004-6, by Assignment securing a Note in the original principal amount of $101,750.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, October 7, 2008, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being in GMD 245, Jackson County, Georgia, being known and designated as Lot 11, Finch Landing, Phase I, as more particularly described on a plat of survey recorded in Plat Book 62, Page 35 and 36, Jackson County, Georgia Records, reference to said plat of survey and the record thereof being hereby made for a more complete legal description.
Said property is known as 75 Sparrow Lane, Jefferson, GA 30549, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Rose A. Hernandez, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Rose A. Hernandez, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.

Nicholson 115kV Transmission Line Tap
Pursuant to O.C.G.A. § 22-3-160 you are hereby notified of certain rights afforded by law concerning a proposed 115 kV electric transmission line to be constructed in Jackson County. Georgia Transmission Corporation (GTC), along with other members of Georgia’s Integrated Transmission System, continuously monitor and assess the performance and capability of Georgia’s electric system. A recent evaluation revealed that the electric system serving the Nicholson area in Jackson County will exceed its operating capacity under high load conditions by 2010. GTC plans to construct the Nicholson 115 kV Transmission Line in the area of the preferred route set forth below and Nicholson 115/25 kV Substation to address this problem.
GTC will conduct an open house public meeting concerning this project. The meeting will take place on Tuesday, October 28, 2008 from 6:00 p.m. to 8:00 p.m. It will be held at The Nicholson Community Center, located at 129 Lakeview Drive, Nicholson, GA 30565.
The purpose of this meeting is to provide public notice of GTC’s intent to acquire easements for and to construct the Nicholson 115 kV Transmission Line for which the right of eminent domain may be exercised. GTC representatives will be on hand to provide information and take questions and comments about the project.
The general route of the approximate 1-mile transmission line will begin at a tap point along Georgia Power’s existing Center Primary - Commerce Primary 115 kV Transmission Line approximately .23 miles south of Berea Road. From there, the Nicholson Transmission Line will run west cross-country to the existing Southern railroad that parallels the east side of US Highway 441. From there, it will run south parallel to the east side of the railroad and will turn west, cross over the railroad and into the proposed Nicholson Substation on the south side of Cedar Drive. The transmission line corridor is located in Jackson County’s 253rd Georgia Militia District. It will require easements approximately 100 feet wide. This preferred route was selected after consideration of existing land uses in the geographic area where the line is to be located, existing corridors, existing environmental conditions in the area, engineering practices relating to the construction and operation of the line, and costs relating to the construction, operation, and maintenance of the line.
The proposed construction approach for this transmission line is overhead construction using single poles made of concrete or steel. This approach was chosen because it meets the engineering, construction, operational, environmental, schedule, cost, electrical, and reliability requirements of the project. Alternative construction approaches considered but rejected were:
(1) No Build/Take No Action: The Nicholson area is served by three different circuits from three different directions. These circuits range in length from 5.5 miles to 8.5 miles. These circuits converge in the Nicholson Area. If no action is taken, the 25kV distribution circuits that converge into the area begin to overload by 2009. Furthermore, throughout the study period, there is deficient transformer and circuit capacity at neighboring substations including Jefferson, Louisiana Pacific, Neese and Commerce City #4 Substations.
(2) Upgrade the existing electrical distribution system, and make improvements to existing transmission delivery facilities: This option was rejected due to excessive cost associated with area improvements which will only delay the need for the substation for several years. It also provides limited back up capability as compared to the preferred option. In addition, the substation sources would be further away from the center of the geographic area needing the electrical service resulting in increased distribution exposure and reduction of reliable electric service to the area until the construction of a new substation.
The accepted alternative approach was:
(3) Installation of new transmission facilities. In this alternative, Georgia Transmission Corporation would construct a new substation called Nicholson. Three distribution circuits would be initially built out of this substation to serve the area. This alternative provides a reliable source to serve approximately 20 MVA of load and is positioned to serve up to 50 MVA of load sufficient for the long term. This substation will also provide a strong back up source to other area substations, namely Jefferson, Commerce City #4, Neese and Louisiana Pacific Substations.
Representatives of Georgia Transmission Corporation will contact property owners that are directly affected by the construction of this transmission line. Clearing for the transmission line is scheduled to begin in the summer of 2009. The line and substation are scheduled to be ready for service in the fall of 2009.

Nicholson 115kV Transmission Line Tap
Pursuant to O.C.G.A. § 22-3-160 you are hereby notified of certain rights afforded by law concerning a proposed 115 kV electric transmission line to be constructed in Jackson County. Georgia Transmission Corporation (GTC), along with other members of Georgia’s Integrated Transmission System, continuously monitor and assess the performance and capability of Georgia’s electric system. A recent evaluation revealed that the electric system serving the Nicholson area in Jackson County will exceed its operating capacity under high load conditions by 2010. GTC plans to construct the Nicholson 115 kV Transmission Line in the area of the preferred route set forth below and Nicholson 115/25 kV Substation to address this problem.
GTC will conduct an open house public meeting concerning this project. The meeting will take place on Tuesday, October 28, 2008 from 6:00 p.m. to 8:00 p.m. It will be held at The Nicholson Community Center, located at 129 Lakeview Drive, Nicholson, GA 30565.
The purpose of this meeting is to provide public notice of GTC’s intent to acquire easements for and to construct the Nicholson 115 kV Transmission Line for which the right of eminent domain may be exercised. GTC representatives will be on hand to provide information and take questions and comments about the project.
The general route of the approximate 1-mile transmission line will begin at a tap point along Georgia Power’s existing Center Primary - Commerce Primary 115 kV Transmission Line approximately .23 miles south of Berea Road. From there, the Nicholson Transmission Line will run west cross-country to the existing Southern railroad that parallels the east side of US Highway 441. From there, it will run south parallel to the east side of the railroad and will turn west, cross over the railroad and into the proposed Nicholson Substation on the south side of Cedar Drive. The transmission line corridor is located in Jackson County’s 253rd Georgia Militia District. It will require easements approximately 100 feet wide. This preferred route was selected after consideration of existing land uses in the geographic area where the line is to be located, existing corridors, existing environmental conditions in the area, engineering practices relating to the construction and operation of the line, and costs relating to the construction, operation, and maintenance of the line.
The proposed construction approach for this transmission line is overhead construction using single poles made of concrete or steel. This approach was chosen because it meets the engineering, construction, operational, environmental, schedule, cost, electrical, and reliability requirements of the project. Alternative construction approaches considered but rejected were:
(1) No Build/Take No Action: The Nicholson area is served by three different circuits from three different directions. These circuits range in length from 5.5 miles to 8.5 miles. These circuits converge in the Nicholson Area. If no action is taken, the 25kV distribution circuits that converge into the area begin to overload by 2009. Furthermore, throughout the study period, there is deficient transformer and circuit capacity at neighboring substations including Jefferson, Louisiana Pacific, Neese and Commerce City #4 Substations.
(2) Upgrade the existing electrical distribution system, and make improvements to existing transmission delivery facilities: This option was rejected due to excessive cost associated with area improvements which will only delay the need for the substation for several years. It also provides limited back up capability as compared to the preferred option. In addition, the substation sources would be further away from the center of the geographic area needing the electrical service resulting in increased distribution exposure and reduction of reliable electric service to the area until the construction of a new substation.
The accepted alternative approach was:
(3) Installation of new transmission facilities. In this alternative, Georgia Transmission Corporation would construct a new substation called Nicholson. Three distribution circuits would be initially built out of this substation to serve the area. This alternative provides a reliable source to serve approximately 20 MVA of load and is positioned to serve up to 50 MVA of load sufficient for the long term. This substation will also provide a strong back up source to other area substations, namely Jefferson, Commerce City #4, Neese and Louisiana Pacific Substations.
Representatives of Georgia Transmission Corporation will contact property owners that are directly affected by the construction of this transmission line. Clearing for the transmission line is scheduled to begin in the summer of 2009. The line and substation are scheduled to be ready for service in the fall of 2009.
