A 19-YEAR-OLD Nicholson man was arrested last week for hitting a man over the head with a two-by-four to apparently prevent him from drinking and driving.
A deputy was called out to investigate a battery report on Ed Bennett Road and met with the 32-year-old male victim, who had a minor laceration on the top rear area of his head.
The victim said that his girlfriend had become angry at him because he drank a large quantity of beer. He said the accused was a “visiting acquaintance” whom he told to “put him out.”
After the accused admitted to striking the victim in the head with a board to prevent him from drinking and driving, he was arrested and taken to jail.
The victim refused medical treatment.
He refused medical treatment, so evidently he wasn't injured very bad.
The young man prevented the drunk from endangering lives and property by driving! I wish more people would take the initive to stop someone from drinking and driving!
Me? I just thought the story was entertaining!
The offender did the community a service and may have potentially even saved others lives from an intoxicated driver.
Yet by law the police have to take him in for the battery which was reported and proven true no matter what the case may be.

Quite possibly, the reason for this based on the limited information we have, is that you simply can not commit a crime to "prevent" a possible crime that hasn't even occoured yet. Based on your logic, we should all arm ourselves with 2x4's, stand outside of the bars, and smack every drunk person that walks outside across the head . . . just to make sure no one drinks and drives. Yeah, great plan!!
Now I hate drunk drivers as much as the next person, but hitting someone across the head with a 2x4? Probably could come up with something a little less extreme. (Yes, it is a crime to hit someone in the head with an object. Look it up if you don't believe me.)And no Angela, it's not a crime to be drunk at a personal residence. You can actually drink beer and get drunk in Georgia and not go to jail. (GASP! wow, didn't know that huh?)
. . . and Mike, do you know this by your personal experience of drunk driving and not being caught? or are you simply speculating? In the last weekly report listed here on the Herald, I count 6 DUI's arrested. I guess they just drove up into the places they were "hid away" huh?
I do think they should have just counted it as a disturbance calmed everyone down and left it alone. I also don't understand what the comment about 'put him out' means in the article..
