By virtue of the power of sale contained in that certain Construction Loan Deed to Secure Debt and Security Agreement from SOUTHWIDE AT MAGNOLIA POINTE, LLC, to BANK OF NORTH GEORGIA, dated March 8, 2006, filed for record March 24, 2006, and recorded in Deed Book 43-D, Page 603, Jackson County, Georgia Records, said Construction Loan Deed to Secure Debt and Security Agreement having been given to secure a Commercial Promissory Note dated March 8, 2006, in the original principal sum of TWO HUNDRED TWELVE THOUSAND AND 00/100 DOLLARS ($212,000.00), and renewed by Promissory Notes on April 16, 2007, and on October 31, 2007, with interest from date at the rate stated in said Promissory Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Jackson County, Georgia within the legal hours of sale on the first Tuesday in September, 2008, the property described on Exhibit “A” attached hereto and incorporated herein by reference. The debt secured by said Construction Loan Deed to Secure Debt and Security Agreement has been and is hereby declared due because of, among other possible events of default, non-payment of the indebtedness as and when due. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney’s fees.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Construction Loan Deed to Secure Debt and Security Agreement. The Georgia Environmental Protection Division (EPD) has recently received an application for issuance of a permit for an electric generating facility capable of generating 2660 megawatts (MW) of electricity. It is EPD’s policy that, upon receipt of any such application, a public notice shall be issued in a paper of general circulation in the county in which the facility proposes to operate or, is already operating, and any county whose border is within five miles of any portion of the existing or proposed property of the facility.
Dahlberg Combustion Turbine Electric Generating Facility (Plant Dahlberg) has proposed to construct and operate four (4) additional simple cycle dual-fired (natural gas or ultra low sulfur fuel) combustion turbines, auxiliary support equipment and one (1) fuel oil storage tank and will have a total capacity of 760 megawatts (MW). The existing facility contains ten (10) simple cycle combustion turbines, auxiliary support equipment, four (4) fuel gas heaters and one (1) fuel oil storage tank and has a total nominal capacity of 1900 MW.
The proposed facility is located at 585 Jarrett Road, Nicholson, Georgia, on approximately 276 acres of land located in Jackson County, south of Commerce, Georgia. This application is subject to the Federal Prevention of Significant Deterioration (PSD) Regulations, 40 CFR 52.21.
You are hereby notified of the opportunity to submit written public comments and/or request a public hearing concerning this application. Dahlberg Combustion Turbine Electric Generating Facility (Plant Dahlberg) has proposed to construct and operate four (4) additional simple cycle dual-fired (natural gas or ultra low sulfur fuel) combustion turbines, auxiliary support equipment and one (1) fuel oil storage tank and will have a total capacity of 760 megawatts (MW). The existing facility contains ten (10) simple cycle combustion turbines, auxiliary support equipment, four (4) fuel gas heaters and one (1) fuel oil storage tank and has a total nominal capacity of 1900 MW.
The proposed facility is located at 585 Jarrett Road, Nicholson, Georgia, on approximately 276 acres of land located in Jackson County, south of Commerce, Georgia. This application is subject to the Federal Prevention of Significant Deterioration (PSD) Regulations, 40 CFR 52.21.
