All that tract or parcel of land lying and being in the 245 G.M.D., City of Jefferson, Jackson County, Georgia, containing 0.542 acre as shown on plat of survey prepared for Michael Todd Casper and Angela Grace Casper by Robert T. Black, Surveyor, dated January 15, 1992, and being more particularly described as follows: beginning at an iron pin found on the northeasterly right of way of Memorial Drive (100 foot right of way) 468.3 feet along said right of way from the right of way of Duke Street; running thence north 64 degrees 24 minutes 43 seconds east 164.4 feet to an iron pin found; thence south 35 degrees 05 minutes 49 seconds east 30.51 feet to an iron pin found; thence south 34 degrees 38 minutes 09 seconds east 102.51 feet to an iron pin found; thence south 56 degrees 02 minutes 00 seconds west 163.05 feet to an iron pin found on the easterly right of way of Memorial Drive; running thence along said right of way north 34 degrees 30 minutes 08 seconds west 157.03 feet to the point of beginning.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. Under and by virtue of the power of sale contained in a Security Deed from CONRAD DAVIS to UNITED COMMUNITY BANK, dated September 20, 2007, recorded October 1, 2007, in Deed Book 50-G, Page 440 and re-recorded in Deed Book 50-L, Page 514, Jackson County, Georgia Records, as last modified by Modification of Security Deed dated August 6, 2008, recorded in Deed Book 53-D, Page 163, Jackson County, Georgia Records, said Security Deed being given to secure a Note from CONRAD DAVIS dated August 6, 2008, in the original principal amount of SEVENTY THREE THOUSAND TWENTY SIX AND 50/10 ($73,026.50) DOLLARS, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Jackson County, Georgia, within the legal hours of sale on the first Tuesday in March, 2010, the following described property:
