The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys’ fees and other payments provided for under the terms of the Security Deed and Note.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by inspection of the property; any outstanding taxes, including, but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights of way and any other matters of record superior to said Security Deed. Notice of Sale Under Power of Authority Contained in Security Deed
Under and by virtue of the power of sale contained in that Security Deed from JAMES MELVIN GOOCH, JR. and KARI N. GOOCH f/k/a KARI CHRISTINE NESMITH to COMMUNITY BANK AND TRUST, dated September 20, 2004, and recorded in Deed Book 36-F, Page 7 (the (Deed) Jackson County, Georgia Records, such Deed being given to secure obligations arising under: a Real Estate Note dated September 20, 2004, made by Grantor in the original principal amount of $63,901.00 (the (Note), together with interest thereon and other obligations as provided in the Note and Deed (collectively the (Debt(), there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Jackson County, Georgia within the legal hours of sale on the first Tuesday in December, 2009, to wit: December 1, 2009, the following described property:
All that tract or parcel of land lying and being in the 1704th G.M.D., Jackson County, Georgia, and being that 2.00 acres, more or less, designated as Tract Four and that 8.81 acres, more or less, designated as Tract Five, as shown on a plat of survey recorded at Plat Book 58, Page 206, Jackson County, Georgia Records. Said plat is incorporated herein and made a part hereof by reference thereto for a more complete description of the property conveyed herein.
ALSO: A 60 foot easement for purposes of ingress and egress beginning on the southeasterly right of way of Georgia Highway No. 334; traveling thence in a southeasterly direction over and across Tract Six as more particularly shown on the plat of survey referenced above. This easement for ingress and egress shall run with the land.
The Debt is declared immediately due and payable because of, inter alia, default in the payment of the Debt in the manner required by the Notes and Deed. The Sale will be made for the purpose of paying the Debt and all expenses of Sale, including reasonable attorney fee (notice of intention to collect attorney(s fees has been given). The sale shall be subject to all restrictions, liens, easements and encumbrances of record, and all unpaid taxes and assessments, if any, having priority over the Deed. To the undersigned(s knowledge, information and belief, Grantor is in possession of but does not occupy the property which is known as 10641 Highway 334, Nicholson, GA 30565.
