Delinquent Property Tax Sale
Under and by virtue of certain tax Fi. Fa.’s issued by the Tax Commissioner of Jackson County, Georgia, in favor of the State of Georgia and County of Jackson, against the following named persons and the property as described next to their respective name(s). There will be sold for cash or certified funds at public outcry, before the Courthouse door in Jefferson, Jackson County, Georgia, between the legal hours of sale, on the first Tuesday in November, 2009, the same being November 3, 2009, and continuing on Wednesday, November 4, 2009, if necessary between the legal hours of sale, 10:00 AM and 4:00 PM. YOU ARE HEREBY NOTIFIED that on the 10th day of November, 2009, at 9:00 A.M., at the Jackson County Courthouse in the City of Jefferson, Georgia, the presiding Judge of the Superior Court of Jackson County will hear the case of the STATE OF GEORGIA v. JACKSON COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY and JACKSON COUNTY, GEORGIA, Civil Action File No. B09CV1682, in the Superior Court of Jackson County, the same being a proceeding to confirm and validate an issue of Jackson County Industrial Development Authority (Georgia) Revenue Refunding Bonds (Jackson County Economic Development Projects), Series 2009, (the “Series 2009 Bonds”), in the aggregate principal amount of $40,930,000 to be issued by the Jackson County Industrial Development Authority (the “Authority”) for the purpose of (i) providing funds to currently refund the outstanding principal amount of the Jackson County Industrial Development Authority Revenue Bond (Jackson County Economic Development Projects), Series 2008, and (ii) paying all expenses incident to accomplish the refunding, so as to effect a savings on the debt service requirements of the Jackson County’s (the “County”) now outstanding bonded indebtedness. In said proceeding, the Court will also pass upon the validity of an Intergovernmental Contract, dated as of November 1, 2009, between the Authority and the County, relating, among other things, to the obligation thereunder by the County to pay to the Authority amounts sufficient to pay the debt service on the Series 2009 Bonds and to levy ad valorem property tax on all property in the County subject to such tax, in order to pay debt service on the Series 2009 Bonds, and the validity of the Bond Resolution of the Authority in connection with the issuance of the Series 2009 Bonds.
Any citizen of the State of Georgia residing in Jackson County, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.
THE AUTHORITY WILL NOT CONDUCT ANY PERFORMANCE AUDIT OR PERFORMANCE REVIEW WITH RESPECT TO THE BONDS AS SUCH TERMS ARE DESCRIBED IN SECTION 36-82-100, OFFICIAL CODE OF GEORGIA ANNOTATED.
