Comes now the State of Georgia by and through the District Attorney for the Piedmont Judicial Circuit and files this complaint pursuant to O.C.G.A. Section 16-13-49 and shows the Court the following:
1. The property sought to be forfeited is described as follows: $19,130.00 lawful U.S. Currency.
2. The property sought to be forfeited is presently located in Jackson County and is subject to the jurisdiction of this Court.
3. Said property was seized by Investigator Trey McConnell of the Jackson County Sheriff’s Office pursuant to lawful authority on August 18, 2009, at 120 Johnson Drive, Braselton, Jackson County, Georgia, and is presently in the custody of Evidence Custodian STEVE SMITH, Jackson County Sheriff’s Office.
4. Names and addresses of all those who may be owners of said property are as follows: James Craig Smith, 212 Booth Road, Statham, GA 30666.
5. There are no other known interest holders on said property.
6. On August 18, 2009, Investigator Trey McConnell coordinated controlled buy through a confidential informant that took place at 120 Johnson Drive in Braselton. After the controlled buy took place, Investigator McConnell prepared a search warrant for 120 Johnson Drive. The search warrant was signed by Judge Chandler and executed that same night. Methamphetamine was found during the execution of the search warrant. During the execution of the search warrant, James Craig Smith was called to the house to sell some methamphetamine. The owner of the house described Smith’s car. Smith arrived driving the described vehicle and knocked on the basement door. Smith was ordered to get on the ground and searched for weapons. Smith was carrying a black bag with $19,130.00 in lawful U.S. Currency.
7. Said $19,130.00 lawful U.S. Currency is contraband and forfeited to the State pursuant to O.C.G.A. 16-13-49 (d)(2) in that said property was available for use, directly or indirectly to facilitate the possession, purchase or sale of methamphetamine and pursuant to O.C.G.A. 16-13-49 (d)(6) in that said property constitutes money found in close proximity to the methamphetamine.
WHEREFORE, the State of Georgia prays:
1) that the petition be filed;
2) that all owners and interest holders listed above be personally served with a copy of the complaint and summons;
3) that Evidence Custodian Steve Smith, Jackson County Sheriff’s Office be ordered to remain custodian of said property pending further order of the Court;
4) that the owner of said property be required to file his defense, if any, within 30 days from the date of service of this petition;
5) that the Court enter a judgment in favor of the State of Georgia declaring said property forfeited to the State of Georgia;
6) that the Court order any claimant who fails to establish that a substantial portion of the claimant’s interest is exempt from forfeiture, pay to the State of Georgia the actual costs incurred in the investigation and prosecution of this action including reasonable attorney’s fees as provided by O.C.G.A. Section 16-13-49 (t)(3);
7) that the Court retain jurisdiction to direct the proper disposition and distribution of the property which is forfeited as provided by O.C.G.A. Section 16-13-49 (u)(4);
8) that the State of Georgia be afforded such other relief and remedies as are available under law.

Comes now the State of Georgia by and through the District Attorney for the Piedmont Judicial Circuit and files this complaint pursuant to O.C.G.A. Section 16-13-49 and shows the Court the following:
1. The property sought to be forfeited is described as follows: $19,130.00 lawful U.S. Currency.
2. The property sought to be forfeited is presently located in Jackson County and is subject to the jurisdiction of this Court.
3. Said property was seized by Investigator Trey McConnell of the Jackson County Sheriff’s Office pursuant to lawful authority on August 18, 2009, at 120 Johnson Drive, Braselton, Jackson County, Georgia, and is presently in the custody of Evidence Custodian STEVE SMITH, Jackson County Sheriff’s Office.
4. Names and addresses of all those who may be owners of said property are as follows: James Craig Smith, 212 Booth Road, Statham, GA 30666.
5. There are no other known interest holders on said property.
6. On August 18, 2009, Investigator Trey McConnell coordinated controlled buy through a confidential informant that took place at 120 Johnson Drive in Braselton. After the controlled buy took place, Investigator McConnell prepared a search warrant for 120 Johnson Drive. The search warrant was signed by Judge Chandler and executed that same night. Methamphetamine was found during the execution of the search warrant. During the execution of the search warrant, James Craig Smith was called to the house to sell some methamphetamine. The owner of the house described Smith’s car. Smith arrived driving the described vehicle and knocked on the basement door. Smith was ordered to get on the ground and searched for weapons. Smith was carrying a black bag with $19,130.00 in lawful U.S. Currency.
7. Said $19,130.00 lawful U.S. Currency is contraband and forfeited to the State pursuant to O.C.G.A. 16-13-49 (d)(2) in that said property was available for use, directly or indirectly to facilitate the possession, purchase or sale of methamphetamine and pursuant to O.C.G.A. 16-13-49 (d)(6) in that said property constitutes money found in close proximity to the methamphetamine.
WHEREFORE, the State of Georgia prays:
1) that the petition be filed;
2) that all owners and interest holders listed above be personally served with a copy of the complaint and summons;
3) that Evidence Custodian Steve Smith, Jackson County Sheriff’s Office be ordered to remain custodian of said property pending further order of the Court;
4) that the owner of said property be required to file his defense, if any, within 30 days from the date of service of this petition;
5) that the Court enter a judgment in favor of the State of Georgia declaring said property forfeited to the State of Georgia;
6) that the Court order any claimant who fails to establish that a substantial portion of the claimant’s interest is exempt from forfeiture, pay to the State of Georgia the actual costs incurred in the investigation and prosecution of this action including reasonable attorney’s fees as provided by O.C.G.A. Section 16-13-49 (t)(3);
7) that the Court retain jurisdiction to direct the proper disposition and distribution of the property which is forfeited as provided by O.C.G.A. Section 16-13-49 (u)(4);
8) that the State of Georgia be afforded such other relief and remedies as are available under law.
