All that tract or parcel of land lying and being in the 248th District, G.M., Jackson County, Georgia, containing 7.89 acres as shown by that certain plat of survey entitled “Survey for Cheryl M. West”, dated December 7, 1987, prepared by Terrell & Associates, certified by Roy A. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. YOU ARE HEREBY NOTIFIED that on the 21st day of April, 2009, the presiding Judge of the Jackson County Superior Court, will hear the case of the State of Georgia versus City of Jefferson Public Building Authority and the City of Jefferson, Georgia, Civil Action File Number B09CV0562, in Jackson County Superior Court, the same being a proceeding to confirm and validate City of Jefferson Public Building Authority Refunding Revenue Bonds (Water and Sewer Facilities Project), Series 2009, in the aggregate principal amount of not to exceed $6,500,000 (the “Series 2009 Bonds” or the “Bonds”).
The Series 2009 Bonds are to be issued by the City of Jefferson Public Building Authority (the “Authority”), for the purpose of (1) refunding the City of Jefferson, Georgia Water and Sewerage Revenue Bonds, Series 1998, in the outstanding principal amount of $3,935,000 (the “Series 1998 Bonds”), issued pursuant to an ordinance adopted by the City of Jefferson, Georgia on November 5, 1998 and (2) prepaying up to $2,800,000 of principal amount of the following loans to the City from the Georgia Environmental Facilities Authority (the “GEFA Loans): (i) GEFA Loan #97-L15WJ in the original principal amount of $503,415.16, bearing interest at a rate of 4.76%, (ii) GEFA Loan #200l-L89WS in the original principal amount of $656,200.61, bearing interest at a rate of 5.15%, (iii) GEFA Loan #2002-L18WQ in the original principal amount of $653,679.42, bearing interest at a rate of 4.65%, (iv) GEFA Loan #2005-L06WS in the original principal amount of $712,480.96, bearing interest at a rate of 4.20%, and (v) GEFA Loan #95-S9IWJ in the original principal amount of $1,144,199.61, bearing interest at the rate of 5.23%, all in furtherance of the public purpose for which the Authority was created.
The Series 2009 Bonds shall be issued under and secured by a Trust Indenture, to be dated as of May 1, 2009 (the “Indenture”), to be entered into between the Authority and Regions Bank, Atlanta, Georgia, as trustee (the “Trustee”), and a resolution of the Authority duly adopted on March 23, 2009 (the “Bond Resolution”). The City and the Authority will enter into a Lease Agreement, dated as of May 1, 2009 (the “Agreement”), under the terms of which the Authority has agreed to acquire from the City its water and sewer system (the “System”), and then lease the System back to the City as part of the proposed refunding of the Series 1998 Bonds and the prepayment of up to $2,800,000 of principal amount of the GEFA Loans, and the City has agreed to pay the Authority rental payments sufficient to pay the principal of, redemption premium (if any), and interest on the Bonds as the same become due and payable, all described in the Agreement, and the City has agreed to pay the Authority rental payments sufficient to pay the
principal of, redemption premium (if any), and interest on the Bonds as the same become due and payable. The Agreement and all right, title and interest of the Authority in all moneys and securities from time to time held by the Trustee under the terms of the Indenture will be pledged and assigned for the benefit of the owners, from time to time, of the Bonds under the Indenture.
In said proceeding the Court will pass upon the validity of the Bonds. The Court will also pass upon the validity of said Lease Agreement and the Indenture. THE AUTHORITY HAS WAIVED THE PERFORMANCE AUDIT AND PERFORMANCE REVIEW REQUIREMENTS PROVIDED IN O.C.G.A. § 36-82-100 AND WILL CONDUCT NO PERFORMANCE AUDIT OR PERFORMANCE REVIEW WITH RESPECT TO THE BONDS.
Any citizen of the State of Georgia residing in Jackson County, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.

The Series 2009 Bonds shall be issued under and secured by a Trust Indenture, to be dated as of May 1, 2009 (the “Indenture”), to be entered into between the Authority and Regions Bank, Atlanta, Georgia, as trustee (the “Trustee”), and a resolution of the Authority duly adopted on March 23, 2009 (the “Bond Resolution”). The City and the Authority will enter into a Lease Agreement, dated as of May 1, 2009 (the “Agreement”), under the terms of which the Authority has agreed to acquire from the City its water and sewer system (the “System”), and then lease the System back to the City as part of the proposed refunding of the Series 1998 Bonds and the prepayment of up to $2,800,000 of principal amount of the GEFA Loans, and the City has agreed to pay the Authority rental payments sufficient to pay the principal of, redemption premium (if any), and interest on the Bonds as the same become due and payable, all described in the Agreement, and the City has agreed to pay the Authority rental payments sufficient to pay the

The Agreement and all right, title and interest of the Authority in all moneys and securities from time to time held by the Trustee under the terms of the Indenture will be pledged and assigned for the benefit of the owners, from time to time, of the Bonds under the Indenture.
In said proceeding the Court will pass upon the validity of the Bonds. The Court will also pass upon the validity of said Lease Agreement and the Indenture. THE AUTHORITY HAS WAIVED THE PERFORMANCE AUDIT AND PERFORMANCE REVIEW REQUIREMENTS PROVIDED IN O.C.G.A. § 36-82-100 AND WILL CONDUCT NO PERFORMANCE AUDIT OR PERFORMANCE REVIEW WITH RESPECT TO THE BONDS.

Because of a default in the payment of the indebtedness secured by a Security Deed executed by LESLIE A. FRANK to WELLS FARGO HOME MORTGAGE, INC., dated August 10, 2001, and recorded in Deed Book 24-D, Page 732, Jackson County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Countrywide Home Loans, Inc., by Assignment securing a Note in the original principal amount of $114,207.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, May 5, 2009, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being in the 253rd (Newton) District G.M., Jackson County, Georgia, and in the City of Nicholson, Georgia, containing 0.615 acres, more or less, as more particularly described according to a plat prepared by Ingram, Lord & Associates, Registered Surveyors, dated December 3, 1999, and recorded in the Office of the Clerk of Superior Court of Jackson County, Georgia, in Plat Book 54, Page 166. Said survey is incorporated herein by reference for a more detailed description of said property. Subject to existing easements and right of way for public utilities and rights of way now in use.
Said property is known as 323 Mulberry Street, Nicholson, GA 30565, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Leslie A. Frank, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Leslie A. Frank, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
